Nothing is known about Justice's family background. All that can be said with certainty is that the internal address given on his correspondence with the Horse Guards about his application for a first commission in 1865 was "18 Queen Square Bath". Bath was a favourite locale for retirees. This, and the place of Justice's birth, might indicate that his father was a retired officer of either the British or Indian armies, or else a retired member of the Indian Civil Service.
